  December 21, 2013: Employers Reminded of Holiday Pay

Labor and Employment Secretary Rosalinda Baldoz reminded employers to comply with pay rules for the coming regular holidays to boost the productivity of their workers.
“Voluntary compliance with labor laws, including correct wage payment during holidays, denotes workplace excellence and redounds to the competitiveness of business and the country’s industries,” Baldoz said.
Baldoz said this includes the three regular holidays: Christmas Day on Dec. 25, Rizal Day on Dec. 30, and New Year on Jan. 1.
Christmas celebrates the birth of Jesus Christ, while Rizal Day commemorates the execution of the country’s national hero, Dr. Jose Rizal.
Under the pay rules, employees will receive twice their regular pay during the said holiday.
If they will exceed the first eight hours, they will receive an additional 30 percent of their hourly rate during the holiday.
They will also get another 30 percent of their regular holiday hourly rate if it will coincide with their day-off and they report for work.
However, employees who will not report for work will still receive their full daily pay, as mandated by the wage rules for a regular holiday.
Baldoz also said that a “no-work, no-pay” scheme will take effect for Dec. 24, and Dec. 31, which were declared by Malacañang as a special non-working holidays.
Employees who will not report for work during this special non-working holiday will not be paid unless their company’s policy or collective bargaining agreement (CBA) says otherwise.
However, those who will work for the first eight hours of their duty during this holiday will receive an additional 30 percent of their daily rate.
If they will work overtime, they will be entitled to another 30 percent of their hourly rate on the said day.
Employees whose day-off coincides with the special holiday will receive an additional 50 percent of their daily rate during their first eight hours of their duty.
Baldoz said companies which will not comply with these rules could face sanctions from DOLE.
